DARK TRADING MARKETS ARE TARGET OF NEW HOUSE BILL
In the first major victory of the new Congress for members of the Commodity Markets Oversight Coalition (or "CMOC"), the House Committee on Agriculture today finished work on the Derivatives Markets Transparency and Accountability Act of 2009 (H.R. 977). The bill was reported favorably out of committee after committee members debated it during an afternoon markup. The new bill will bring regulation to the now "dark" U.S. derivatives market, which has been estimated at over $60 trillion--almost five times U.S. annual GDP.

The Commodity Markets Oversight Coalition, coordinated by NEFI Vice President for Government Affairs Jim Collura and formed by NEFI and PMAA two years ago, had testified in favor of the bill last week, with several members recommending key changes to the bill. Some of those changes made it in, some did not. The bill reported out of committee includes provisions that will:

• Close the "Foreign Markets Loophole" which currently allows U.S. traders to evade federal oversight by establishing or trading on off-shore exchanges;

• Close the "Swap Trading Loophole" which currently allows index and swap traders an exemption from limits on the size of the positions they can take in the market (known as "position limits");

• Fully close the "Enron Loophole" by requiring nearly all over-the-counter trades to be cleared through an exchange, and making them subject to data reporting requirements and position limits (the bill affords an exemption for qualified specialized/customized over-the-counter products needed by commercial industries in order to hedge);

• Calls for public hearings to seek input on adequate position limits from mostly physical players (as in, companies actually taking physical delivery of product);

• Requires the Commodity Futures Trading Commission (CFTC), the federal futures market regulator, to review all regulations, exemptions, exclusions, and "no action" letters which exempt off-shore trading facilities from U.S. oversight;

• Requires studies into the over-the-counter markets and foreign/international markets;

• New staff and resources at the CFTC in order to increase ability to monitor the markets for fraud, manipulation or abuse;

• Allow the CFTC to pursue criminal prosecution; and

• Require diversification of membership within boards of directors and other decision making bodies at boards of trade.

There are still some measures advocated by NEFI, PMAA and several coalition allies that didn't make it into the bill, including a requirement that would have set "aggregate" position limits, however we will continue to call for this important measure. However, today's victory would not have been possible were it not for last minute phone calls and meetings by coalition members, thereby ensuring the bill was not weaker than it otherwise might have been.

It is not clear what is next for the measure, which now awaits consideration by the full House. The measure may have ignited what may turn out to be a fierce turf war between House Agriculture Committee, led by Chairman Collin Peterson (D-MN07) and the House Financial Services Committee, led by Chairman Barney Frank (D-MA04). Both committees are claiming jurisdiction over the derivatives market. We are watching this development closely and are in communication with our coalition allies on the best way forward.

Congress will meet this week to work until the Economic Stimulus package is finished and it is sent to the President, then will recess for the Presidents Day holiday all next week.

CONGRESS PREPARES ECONOMIC STIMULUS FOR FINAL VOTE
We have been trying to keep members up-to-speed as Congress moves forward with an “economic stimulus” package (previous NEON issues). The U.S. House of Representatives passed its version on January 28th by a vote of 244-188 (see how your Reps. voted). The Senate passed its version on February 10th, only after a Compromise bill was struck with a select few moderate Republicans, Sens. Snowe (ME), Collins (ME) and Specter (PA), by a vote of 61-37 (see how your Senators voted).

On Wednesday, February 11th, the House and Senate sent conferees to meet and work out the differences between the two bills. A final bill was hammered out and announced late that day; however the final bill has not yet been made public. So far, only small details have leaked, such as the total price tag ($791 billion). Once details are released, we will update members on the fate of some provisions of interest to NEFI members, including additional LIHEAP, efficiency and weatherization funding, and provisions designed to boost SBA Small Business loans. Once the final bill details become available, we will provide you with a look inside. Members of Congress were preparing a final vote on the package, which President Obama has asked to receive by the Presidents Day holiday.

NEFI AND COALITION ALLIES MEET WITH CFTC CHAIRMAN-DESIGNATE GENSLER
The New England Fuel Institute arranged a meeting with Commodity Futures Trading Commission (CFTC) Chairman-designate Gary Gensler on Tuesday, February 10th. The meeting was held at Petroleum Marketers Association of America offices in Arlington, VA and was joined by several Commodity Markets Oversight Coalition members, including the Air Transport Association, Food & Water Watch, National Farmers Union, Agricultural Retailers Association, and National Association of Shell Marketers. The groups will meet on a conference call next week to discuss the meeting and determine if a coalition endorsement is appropriate, however most coalition members found the meeting to be productive, and Gensler to have been responsive to our concerns. NEFI Vice President Jim Collura and Policy Advisor Elizabeth McCarthy were present at the meeting. Special thanks must go to Elizabeth for her hard work and persistence in setting up the meeting.

INDUSTRY GROUPS MEET WITH MEMBERS OF CONGRESS, URGE LIHEAP FUNDING
On Wednesday, February 11th, industry groups and heating fuel dealers joined with hundreds of low income advocates from around the country and descended on Capitol Hill in support of the Low Income Home Energy Assistance Program (LIHEAP) again next year. Last year, Congress provided the maximum authorized, a total of $5.1 billion, and the coalition of LIHEAP allies again asked for at least that much for FY2010. The event was organized by the National Fuel Funds Network, a 25-year old alliance of LIHEAP stakeholders of which NEFI is a member. The groups argued that, although FY09 saw a doubling of LIHEAP funds, as the National Energy Assistance Directors Association has reported, the current economic and unemployment situation has resulted in a surge in applications for assistance. “Congress needs to keep pace with the number of eligible households in need of assistance, not just the cost of energy” said NEFI Vice President for Government Affairs Jim Collura.

Participants in the event included Al Davis of H.R. Clough (Contoocook, NH), Bill Ermer of Palmer Gas/Ermer Oil (Atkinson, NH), Louise Giguere Leblanc of Giguere & Marchand Oil Company (Woonsocket, RI), Vic Allienello of East Providence Fuel (Providence, RI), NEFI Vice President for Government Affairs Jim Collura, NEFI Policy Advisor Elizabeth McCarthy, Mass Oilheat Council Association Specialist Alisha Frazee, Oil Heat Council of New Hampshire President Bob Garside, Oil Heat Institute of Rhode Island Executive Director Julie Gill, and Fuel Merchants Association of New Jersey Executive Director Eric DeGesero.

Most notably, the industry delegation from Rhode Island joined NEFI representatives Collura and McCarthy and Fuel Funds Network Board members to present Senator Jack Reed (D-RI) with a special plaque honoring his years of support for the LIHEAP program and the needs of low-income energy consumers. Reed was also thanked for his support for the National Oilheat Research Alliance (he will be the primary Senate sponsor of the NORA reauthorization bill again this year).

EPA OKS USE OF TERM 'BIOHEAT®' ON SHIPPING PAPERS AND DELIVERY TICKETS
The U.S. Environmental Protection Agency (EPA) has granted NEFI’s request to permit the use of the term “Bioheat” in required language for heating oil on product transfer documents (PTDs), including shipping papers and delivery tickets. The change was requested to provide heating oil dealers a marketing tool for heating oil blended with renewable biodiesel. Either of the following two descriptors may be used to satisfy the EPA’s sulfur content disclosure requirements for heating oil sold in the Northeast Mid-Atlantic (NEMA) area.

Required language:
“Dyed Unmarked Heating Oil: Not for use in highway, nonroad, locomotive or marine engines.”

Newly approved alternative language:
“Dyed Unmarked Bioheat Heating Oil: Not for use in highway, nonroad, locomotive or marine engines.”

EPA SENDS PROPOSED RENEWABLE FUEL STANDARD RULE TO OMB FOR REVIEW
The EPA has sent a long awaited and overdue proposed rule amending the federal renewable fuel standard (RFS) to the White House Office of Management and Budget (OMB) for review. OMB review is the final step in the regulatory process before the proposed rule is published and opened for public comment. The EPA was required to implement regulatory changes to the renewable fuel standard (RFS) under the Energy Independence and Security Act of 2007. Among other things, the proposed rule will set forth the types of fuels the EPA will allow in order to meet an ambitious renewable fuel mandate. The mandate currently requires 11.5 billion gallons of renewable fuels be blended into conventional fuel each year, an amount that will increase until the mandate tops off at 36 billion gallons in 2022.

Bioheat blends may also be credited toward the annual RFS mandate. The rule is important to petroleum marketers because the EPA is considering an increase in the current 10% maximum ethanol content allowed in gasoline sold for use in conventional fuel automobiles to between 12% and 15%. Without the bump up to E12 or E15, the EPA will soon hit a “blend wall” at 14 billion gallons and be unable to meet scheduled annual increases with E10 alone. Increasing the maximum ethanol content raises liability concerns for marketers because existing storage and dispensing equipment are typically certified for a maximum E10 blend, although there is considerable debate whether an increase to E12 or E15 would cause any harm. Liability concerns also extend to conventional fuel engines whose warranties are void for blends above E10. The rule is also expected to include a provision that would allow below-the-terminal rack biodiesel blenders regulatory relief from the RINS attest audit requirements.

• SECOND LOW SULFUR HEATING OIL MEETING SET FOR NEXT WEEK: Next Thursday, February 19, 2009, regional Oilheat stakeholders will meet to discuss the proposed phase-in of lower sulfur heating oil into the Northeastern US market. This is a second meeting, a follow-up of a meeting late last year that heard from Oilheat retailers, wholesaler and suppliers on a proposed phase-in. This second meeting will focus on producer and refiner perspectives, and will hopefully fine-tune a proposal. NEFI Vice President Jim Collura will attend the meeting and report back in a future issue.

• OBAMA ORDERS DOE TO FINALIZE NEW EFFICIENCY STANDARDS: U.S. President Barack Obama has ordered DOE to do everything necessary to finalize new efficiency standards.

• FOR SALE - 165 SUNOCO SITES IN THE EASTERN UNITED STATES: NRC Realty Advisors, LLC (NRC) will administer the sale of 165 Sunoco sites.       Short Term Disability Coverage

      • All Employees that work 30 hours or more per week are eligible for Short Term Disability coverage

      • Employee benefit amounts are based on employee salary

      • The plan design is a benefit of 60% of employee Basic Weekly Earnings, to a weekly maximum benefit of $750
