NEFI ENDORSES NOMINEE TO HEAD U.S. FUTURES TRADING AGENCY
The New England Fuel Institute and allies from the Commodity Markets Oversight Coalition sent a letter of endorsement for President Obama’s pick to head the Commodity Futures Trading Commission (CFTC), the principal regulator of the U.S. futures markets. The letter of endorsement comes after a private coalition meeting with Gary Gensler several weeks ago, in which the Chairman-designate addressed many concerns of NEFI and coalition members. During the meeting, Gensler spoke to his past as a partner with Goldman Sachs, his alleged involvement in the deregulation of the futures markets during his time as an Undersecretary for the Treasury under Clinton, and his attitude toward key reforms being pushed by coalition groups.

NEFI and other coalition members were pleasantly surprised with Gensler’s answers to those questions, answers that he reiterated during this week's Senate confirmation hearing. His "Greenspan-esque" turnaround was evident in his calls for tough new market regulation and strong tone in favor of greater oversight, transparency and enforcement. He said his views have "evolved" since the turn of the century, adding that Congress and the CFTC must now "urgently develop a broad regulatory regime for over-the-counter derivatives markets" and other unregulated trading environments. He also laid out specific calls for new limits on the size of positions that traders can take in the market and that those positions apply to all traders, a top NEFI priority.

NEFI Vice President for Government Affairs Jim Collura and Rob Underwood, PMAA Manager of Congressional Relations, attended the hearing, and wished Gensler luck as his nomination now awaits a floor vote. He has promised a working dialogue and support for many industry and consumer priorities if confirmed by the Senate, which is expected. This would be a major development and may lead to real transparency and accountability in these markets, a shift in direction from immediate past (Acting) Chairman Walter Lukken's regime. During his brief chairmanship, Lukken publicly denied excessive speculation played any role in the price run-ups seen since 2000, even during last year's spike. It is a point with which Gensler greatly differs from Lukken, which leaves us greatly encouraged.

Congress is in session and working on the Fiscal Year 2009 Omnibus Appropriations bill, along with other important matters. Several committees are holding hearings on the Financial Crisis and also on energy and environmental issues, in preparation for major legislation to come.

PRESIDENT ADDRESSES CONGRESS, RELEASES FIRST ANNUAL BUDGET
Earlier this week, President Barack Obama addressed the U.S. Congress, outlining his goals for the nation in the coming year. During his speech, Obama called on Congress to approve new energy policy that includes a national cap & trade program. On Thursday, the President got more specific on the details of his goals and how he would pay for them when he released his $3.55 trillion FY2010 budget. The Congress must now work through the budget and figure out what it likes or wants to change, and work on its appropriations legislation for FY2010 (beginning on October 1, 2009).

Republicans, especially Senate Budget Committee Ranking Member Judd Gregg (R-NH) have spoken out critically on the President’s request, which raises taxes for higher-income Americans and adds $1.17 trillion to the deficit. It also includes a $250 billion “placeholder” for additional bank bailouts that the President believes may be necessary during the next fiscal year.

At first glance, here are some highlights of interest to NEFI members.
The budget recommends:

• $3.2 billion for federal LIHEAP, which is $2 billion less than appropriated by Congress last year but twice the amount requested for FY2009 by then-President Bush. Obama would also like to see a new mechanism that would increase funding whenever there are sharp increases in energy prices. It is not yet clear how this will work. NEFI has joined LIHEAP advocates and asked for $5.1 billion in LIHEAP funding.

• Increasing taxes on upper-income Americans by capping the rate for itemized deductions at 28 percent and letting the Bush tax cuts for high income taxpayers expire (636.7 billion worth over 10 years).

• Making permanent the “Making Work Pay” tax cut included in the stimulus bill, which provides 6.2 percent of earned incomes up to $75,000 ($150,000 for joint filers), for up to a $400 credit for working individuals and $800 for working families; and making permanent the expansion of the Earned Income Tax Credit and the Child Tax Credit, primarily helping low income families.

• A national cap and trade program by 2012, to raise $650 billion through 2019 and help fund $150 billion worth of renewable energy projects over ten years, as well as other programs such as weatherization programs and a national smart grid.

• Eliminating an array of tax cuts for major oil and gas companies
($8 trillion over 10 years).

• Support for Carbon Capture and Sequestration programs.

• $17.5 billion in 7(a) guaranteed loan program.

• $7.5 billion for Section 504 Guaranteed loan program.

• $25 million for the microloan program.

NEFI ATTENDS CARBON TRADING CONFERENCE
NEFI's Shane Sweet, President & CEO, and Elizabeth McCarthy, Policy Advisor, attended a webinar presented by law firm Robinson & Cole's Sustainability and Climate Change Practice Group on February 5th as part of a "Sustainability & Climate Change Series." The webinar focused on 'Carbon Offsets: The What’s, How’s, and Watchout’s,” including 'Offsets 101', 'Generation and Verification', Brokering the Deal', 'Legal Considerations', and 'Marketing and Disclosures.' The fundamental goal of carbon trading and offsets is to both to reduce greenhouse gas (GHG) emissions and to use offsets for regulatory compliance and voluntary commitments. New England and the Mid-Atlantic states initiative in carbon offsets includes both mandatory (only for power generation) and voluntary (all other industries) participation in RGGI (Regional Greenhouse Gas Initiative) which is a market-based carbon emissions reduction program through a system called "cap-and-trade." Legislation is expected in US Congress soon to institute a national mandatory cap-and-trade program that would establish both a carbon auction system and sweeping emission standards cap. EPA WITHDRAWS EXTENSION TO DEADLINE FOR SPCC COMPLIANCE
The U.S. Environmental Protection Agency under new U.S. President Barack Obama has withdrawn an extension of the deadline for Spill Prevention, Control and Countermeasure (SPCC) plan revision and implementation. All fuel dealers that must comply with revised SPCC rules should once again consider July 1, 2009 as the compliance date for SPCC, until further notice. The EPA had originally planned to issue a rulemaking that would extend the deadline until November of this year. However, the deadline extension has been withdrawn in accordance President Obama’s request for a review of all pending or near final rulemakings. Regulatory Counsel Mark S. Morgan, Esq., will monitor the situation and NEFI will do its best to effect a positive change for members. Please note: The previously proposed deadline to the extension for revised SPCC rule compliance is considered a separate rule from the SPCC amendments. OVERLOOKED TAX CREDIT MIGHT HELP STRUGGLING CUSTOMERS PAY BILLS
According to the Internal Revenue Service, as many as seventy-five percent (75%) of eligible American workers (many of which are low-to-moderate income) fail to claim a major and sizable tax credit each year. The federal Earned Income Tax Credit (or EITC) could put as much as $5,000 in their pockets, helping them to pay outstanding bills or make efficiency upgrades to their homes or heating equipment. To qualify, taxpayers must meet certain requirements and file a tax return, even if they did not earn enough money to be obligated to file a tax return. Additionally, the stimulus bill signed into law last week temporarily expands and increases the EITC for working families with three or more children to 45 percent of the family's first $12,570 of earned income (the credit previously allowed for claims of one or two children). It also increase the phase-out income range for all families by $1,880 and expands another tax credit, the Child Tax Credit, to more families by lowering the eligible income level to $8,100. These changes could make even more families eligible for a larger return--although many don’t know it. Additionally, twenty two states and the District of Columbia have a similar state tax credit. • CONGRESS TAKES UP FINAL FISCAL YEAR 2009 APPROPRIATIONS BILL
This week, the U.S. House of Representatives approved the FY2009 “omnibus” appropriations bill, which makes final appropriations for the current fiscal year. The bill does not contain any additional funding for LIHEAP beyond the $5.1 billion that was provided in last year’s continuing resolution, which funded the government through the governmental transition, and expires March 6, 2009. The Senate is expected to take up the measure next week and NEFI is reviewing the spending bill. We will update members in a future issue.

• HEADS OF COMMODITY EXCHANGES MEET WITH INDUSTRY LEADERS
On Thursday, heads of the Chicago Mercantile Exchange (CME) and the New York Mercantile Exchange (NYMEX) met with industry leaders to discuss the need for futures market reform. Industry representatives at the meeting included Sean Cota, NEFI’s immediate past Chairman of the Board (Vt.); Peter Carini of NEFI member Champion Energy (New York); Peter Beutel of Cameron Hanover (Conn.); Gerry Ramm of Inland Oil Company (Wash. State); Jim Collura, NEFI Vice President for Government Affairs; Sherri Cabrerra, Vice President of PMAA; and Rob Underwood, Manager of Congressional Relations for PMAA.

• OBAMA PROMISES REGULATORY REFORM OF FINANCIAL MARKETS
The Hill, outlines and analyzes President Obama’s plan for reforming the U.S. Financial Markets after yesterday’s press conference regarding the issue, which includes regulation of hedge funds, over the counter markets, and a potential merger between the SEC and the CFTC. Read more.

• EPA POISED TO REGULATE CARBON IN LANDMARK DECISION
According to administration insiders, the EPA is poised to determine that carbon is a “dangerous pollutant” that it has the right to regulate, which could begin one of the most extensive and contentious rulemakings in U.S. history. Read more.

• NY OIL HEATING ASSOCIATION EXEC TESTIFIES ON BIOHEAT® MANDATE
John Maniscalco of the New York Oil Heating Assn. testified before a New York City Council hearing on a proposed city-wide Bioheat® mandate. (Read his testimony.) John would also like to thank Shelby Neal, Director of State Governmental Affairs and Don Scott, Director of Sustainability at the National Biodiesel Board (NBB), Paul Nazzaro of Advanced Fuel Solutions (who testified for Michael Ferrante of the Massachusetts Oilheat Council) and John Huber of the National Oilheat Research Alliance, who also delivered expert comments to the City Council. The hearing focused on sustainability issues, benefits for heating oil dealers and consumers and the possible lower sulfur heating oil mandate by regional air quality officials. One of NYOHA’s concerns with the draft bill is that it mandates desulfurization of the fuel. The New York City Council will now revisit the bill, pursue additional co-sponsors and support, and then it's on to the Mayor's office for additional comments. A natural gas leak is believed responsible for an explosion that destroyed a Somerset, Mass., home, killing a woman and her dog. Read more.

There are about a dozen families in the Granite State that have children on a variety of life-supporting systems that do not have electric generators. The call originates from a toll-free number, and the caller may have even identified himself as “Shane”. He then may have proceeded to warn you that hotel rooms for the upcoming NEFI Show in June are going fast and that you need to book now, through him. The caller is not Tracy Goodwin, NEFI Vice President and Director of Events, Shane Sweet, NEFI President and CEO or any other member of NEFI staff.     The National Oilheat Research Alliance was in Attendance at the Institute for Business and Home Safety (IBHS) Annual Conference in Florida

    National Oilheat Research Alliance (NORA) was invited to make a presentation at the Institute for Business and Home Safety (IBHS) Annual Conference. This is the second year that NORA took part in the annual conference with IBHS. NORA’s presentation, entitled "Reducing Losses Related to Oilheat Systems", was well received. Not only was the presentation a success, there was a significant amount of activity at the NORA booth during the conference.

    Among several demonstrations done at the conference, many of the participants were enthusiastic about the Certified Company lookup function on the NORA Education website. Many participants also had a special interest in NORA’s Static Test Process for underground storage tanks.

    Over the past few years NORA and IBHS have worked together on numerous projects, more recently the development of tank inspection procedures and the production of a primer on the Oilheat industry. These materials have been distributed to insurance companies to enable them to understand how the Oilheating industry functions.

    NORA’s relationship with IBHS has enabled homeowners’ and insurance carriers to have an open dialogue with the Oilheating industry, benefiting companies in both industries and consumers alike.

    NORA Energy Conservation Analysis Seminar Provides New E&T

    Constant fluctuations of energy markets have customers concerned about the future. Because of the long-term relationship as their energy providers, customers are turning to Oilheat companies for solutions. Now more than ever we must be part of their solution, not part of the problem. They must see us as their trusted energy adviser.

    Mr. Bob Hedden will present a seminar that will allow technicians to knowledgably guide customers to smarter energy solutions. The training will prepare candidates for the NORA written examination in several core areas. Participants will learn how to be sure the heating system is working at maximum efficiency. A critical component of this program will be to learn what advice we can give customers about free or low cost, "do-it-yourself", projects that they can implement to help lower their energy bills. They will also learn to identify potential problems with the building and recognize when it would be advisable for customers to call in building shell and insulation experts. NORA’s goal for this program is to be sure that every oil-heated building is using energy as efficiently as possible without compromising safety, reliability or comfort. Not only will this insure customers are getting the most from the money they spend heating and cooling their buildings, energy conservation is also the best answer for protecting the environment.

    Upon successful completion of a short test given at the end of the program participants will receive the NORA Energy Conservation Analysis Certification. This national certification is similar to the NORA Tank Certification. The seminar is good for 7 NORA CEUs.
