COTA TELLS CONGRESS ENERGY MARKETS HELD HOSTAGE TO "GREED AND FEAR"
Last year’s record energy prices were the result of "large and excessively-leveraged speculators, index traders and hedge funds," rather than supply and demand, NEFI-member and immediate-past Chairman of the Board Sean Cota (Cota & Cota, Bellows Falls, Vt.) told a Congressional panel on Tuesday, and "American consumers, small businesses and the broader economy were forced onto a roller coaster ride of greed and fear."

Impact of Speculation on Fuel Dealers
Cota, testifying on behalf of both the Petroleum Marketers Association (PMAA) and the New England Fuel Institute (NEFI) explained how motor fuel marketers and heating fuel dealers are pressured, not profited, by high prices. He mentioned how fuel dealers’ credit lines are strained by high prices, and they are forced to severely cut margin, sometimes into the red, in order to remain competitive. He also noted that investment banks’ 2008 predictions of $200 per barrel oil by winter led many customers to demand fixed price contracts and many dealers offered them. “When [the investment-only speculators or ‘investulators’] exited the market in the fall,” Cota said, “heating fuel dealers and their customers who had “locked-in” were committed to a fuel at a much higher cost than it was currently worth.”

Many Loopholes Remain
Cota speaks at an important time, as Wall Street now has a severely diminished image on Capitol Hill and lawmakers are looking to act. Although last year’s nearly $150 per barrel crude oil prices have deflated, there is nothing to stop investment speculation and unregulated trading from helping to drive it there again. Many of the loopholes and gaps in oversight that helped get it here are still in place. The passage of the “Close the Enron Loophole Act” last year was a major victory in an atmosphere of staunch Wall Street opposition, but it only re-regulates certain electronic trading platforms exempted under the “Enron Loophole.” The bill does not address several other major loopholes. These include the “Foreign Markets Loophole,” which allows US traders to evade federal oversight by trading US-destined products on overseas platforms, and the “Swaps Loophole” which grants investment banks and other financial players an exemption from limits on the size of the positions they can take. Also not addressed are the remaining provisions of the “Enron Loophole” that afford blanket regulatory exemptions to over-the-counter (or “off-exchange”) swaps and trades, where a majority of trading now occurs.

New Legislation Being Drafted
The hearing was held to receive comments on the committee’s draft legislation that would close these remaining loopholes. Cota spoke in favor of the draft bill, and made suggestions on ways it could be improved. Cota was accompanied and supported by now DC-based Jim Collura, NEFI Vice President for Government Affairs (jimcollura@nefi.com), as well as PMAA staffers Sherri Cabrera, Director of Legislative Affairs, and Rob Underwood, Manager of Congressional Relations. The two-day hearing also heard from witnesses opposed to much of the bill, including the futures industry and International Swaps & Derivatives Association (ISDA). Their main argument against the bill is that additional regulation of these markets and trades would stifle “free market,” inhibit innovation of off-exchange financial products, and drive business overseas.

The newly elected 111th Congress has begun and is in session. President Barack Obama was sworn in on January 20th, 2009.

SENATE TRIES TO BREAK STALEMATE ON ECONOMIC STIMULUS
As was reported in our last issue, the U.S. Senate has taken up consideration of the now over $900 billion economic stimulus package after the House of Representatives passed their version last week. The large price tag has drawn opposition from many Senate Republicans, who feel that many programs funded by the bill go to boost government programs rather than to stimulate the economy and create new jobs, and argue instead for more and bigger tax breaks for businesses and working families. Democratic leaders have argued that while tax cuts are important, the spending measures will put people to work and provide assistance to those that are unemployed or under-employed. The debate lasted all week and as this issue went to press, Amendments were still being considered on the Senate floor. Senate Majority Leader Reid (D-NV) is now working with a bipartisan group of Senators to draft a compromise and allow the bill to proceed. The compromise may cut as much as $50-100 billion from the bill. Sources have estimated that the bill in its current form is three votes shy of the 60 votes needed to pass. We are following this issue closely and will keep members updated.

INDUSTRY GROUPS TO DESCEND ON CAPITOL HILL IN SUPPORT OF LIHEAP
On Tuesday, February 11th, association representatives and fuel dealers will join energy assistance advocates from around the country in an annual “March on Washington” in support of the federal Low Income Home Energy Assistance Program (LIHEAP). Last year, Congress provided $5.1 billion for the program, the most in the program’s 26-year history. Advocates will request at least as much this year, if not more, due to the many Americans struggling due to the global recession. Participating industry groups this year include the New England Fuel Institute, Massachusetts Oilheat Council, Oilheat Council of New Hampshire, Oilheat Institute of Rhode Island and the Fuel Merchants Association of New Jersey. The event is organized each year by the National Fuel Funds Network (www.nationalfuelfunds.org). More on this in the next issue.

NEFI NOW OFFERS REQUIRED DECALS FOR HANDICAP ASSISTANCE AT FUEL STATIONS
Certain fuel stations are required to display, under the Americans with Disabilities Act (ADA), a decal offering refueling assistance to individuals with a disability. A service station or convenience store is not required to provide such service at any time that it is operating on a remote control basis with a single employee. Failure to provide notification of handicap assistance could result in fines of up to $50,000. Important notes about the requirement:

• A service station or c-store operator must provide refueling assistance upon the request of an individual with a disability. People with disabilities may require assistance to purchase fuel at self-service stations at certain self service pumps. NOTE: C-STORES ARE NOT REQUIRED TO INSTALL ELECTRONIC DEVICES FOR NOTIFICATION SUCH AS BUZZERS OR INTERCOMS.

• The operator is not required to provide such service or notice at any time that it is operating on a remote control basis with a single employee.

• Those service stations or c-store operators that are required to comply with ADA access requirements must notify customers (e.g., using signs on or near dispensers) that individuals with disabilities can obtain refueling assistance by honking their horn or otherwise signaling an employee. The ADA requires no specific wording for the notification. Service stations and c-stores operating on a remote control basis with only one employee are not required to post a notification.

• A service station or c-store operator must provide the refueling assistance without any charge beyond the self-serve price if the customer wants only fuel. The attendant may provide assistance at a self-service pump or at a full-service pump. In either case, the customer must be charged the self-service price.

REGULATORY ALERT: SPCC RULE FREEZE AFFECTS SPCC REGULATORY RELIEF
On January 20, 2009 the Obama administration announced a regulatory review of all “last minute” final rules issued during the waning days of the Bush administration. Agency regulators were ordered to review all such rulemakings to decide whether they were consistent with the policies of the new administration--and if not, to impose a 60-day freeze to allow for additional public comment and possible regulatory change. The EPA announced today that the final SPCC rulemaking published on 12/05/08 that provides significant regulatory relief for bulk plant owners and operators is subject to the freeze. The effect of the freeze is two-fold:

• The 02/03/09 effective date of the SPCC regulatory relief provisions is delayed until 04/04/09. This means that bulk plant owners and operators who are currently revising and implementing SPCC plans must postpone taking advantage of these regulatory relief provisions until 04/04/09 (provided they are not eliminated or changed by the EPA in the interim).

• The EPA is reopening the entire final rule for a 30-day period to seek additional public comment and possible regulatory changes. While the entire rule is technically open for comment, the EPA is concerned only with the provision that allows self certification of SPCC plans for bulk plants under 10,000 gallons capacity (certain parts of the rule that do not apply to petroleum marketers may be subject to change as well, but this is unlikely to effect the regulatory relief provisions). The self-certification provision was not included in the proposed rulemaking stage and therefore never subject to public comment. The EPA is probably reopening the rule to correct this procedural error rather than out of any concern over the regulatory relief provisions.

It is likely that the key provisions in the SPCC rule that are important to small bulk plant owners and operators will be retained after the 30-day comment period closes. The net effect for now is that the regulatory relief provisions will not be available to bulk plant operators or owners until 04/04/09. These provisions include; clarification of the definitions of “facility” and “loading rack” that limits the cost of complying with SPCC regulations; more flexible and cost effective security requirements at bulk plants; streamlined SPCC plans and self-certification for small bulk plants; more flexible integrity testing requirements; and an exemption for parked cargo tank trucks from the sized secondary containment requirements.

A separate rulemaking on January 14, 2009 extended the SPCC compliance deadline from 07/01/09 to 11/20/09. The EPA will decide shortly whether this rulemaking will also be re-opened for public comment and subject to possible change.

General News

• GAO CITES POOR DATA IN REPORTING NO SPECULATION:
This week, Bloomberg News (article unavailable) reported that the Government Accountability Office (GAO) sent a letter to US House Agriculture Chairman Peterson, reporting that speculation had little apparent involvement in the behavior of commodity markets, but the report cited data from government regulators that is extremely limited due to loopholes in federal oversight.

• CFTC CHAIRMAN-DESIGNATE PROMISES TO GET TOUGH ON TRADERS:
In a letter to House Agriculture Committee Chairman Peterson, Chairman-designate for the Commodity Futures Trading Commission (CFTC), the federal futures market watchdog, has promised to support increases in transparency and oversight of the futures market. The letter comes in response to Peterson’s 19-question letter to Gensler, who has received some skepticism from members of Congress and advocates for futures market reform (including NEFI) in light of his relationship to former partner at Goldman Sachs and his past support for index- and swap-trading. • PRESIDENT TAPS SENATOR GREGG FOR COMMERCE POST:
Senator Judd Gregg (R-NH) is in-line to become the next Secretary of Commerce, provided he receives Senate confirmation (which is likely, as early as next week). Gregg is well known for his fiscal conservatism and will be the second Republican in the Obama administration after Transportation Secretary Ray LaHood (Defense Secretary Gates is an Independent). NH Governor Lynch, a Democrat, has announced his selection of former Gregg Chief-of-Staff Bonnie Newman as his replacement. She has promised to only serve out the remainder of Gregg's term (which ends in 2010).

NEFI was contacted by Bob Garside of the Oil Heat Council of New Hampshire with regard to low-income families with sick children. There are about a dozen families in the Granite State that have children on a variety of life-supporting systems that do not have electric generators. Needless to say, when power is lost (as it was recently) this poses a life-threatening crisis for these New Hampshire families. • PRESIDENT OBAMA OKs CIGARETTE TAX INCREASE:
President Obama has signed into law a Children’s Health Bill this week that includes a tax hike for tobacco products, including an increase in cigarette tax to 62 cents per pack. PMAA and the National Association of Convenience Stores (NACS) have been vocal opponents to tobacco tax increases. Read More.

• NACS STUDY: MORE CONSUMERS BLAME SPECULATORS FOR PRICES:
According to a recent study by the National Association of Convenience Stores (NACS), 50 percent of people surveyed believe that speculators were to blame for rising gas prices, up from 34 percent last year and second only to OPEC (61 percent) and government inaction (58 percent). Read More.

• CALIFORNIA STUDY FINDS COSTS IN ATC MANDATE:
According to PMAA, a California Energy Commission (CEC) report has found temperature compensation to be a net-cost for the consumer, and state and regional differences make a national mandate troublesome.

• ENERGY DEPARTMENT SETS UP ALTERNATIVE FUEL LOCATOR:
The US Department of Energy has announced a new tool for motorists to locate alternative fuels in their area, including biodiesel, electricity, E85 (ethanol), hydrogen, natural gas, and propane fueling sites. • NEFI SPRING TRIP TO BE ANNOUNCED SOON: NEFI’s spring trip destination and dates are being decided upon and we expect to have an announcement soon.
