NEFI JOINS COALITION ALLIES IN SUPPORT OF REFORM-MINDED CFTC COMMISSIONER
Members of the Commodity Markets Oversight Coalition (CMOC), an alliance of trade, industry, business and consumer advocacy groups pushing for greater oversight of the futures markets, announced support for the re-nomination of Bart Chilton as Commissioner of the futures watchdog the Commodity Futures Trading Commission (CFTC). "Since taking his seat in August of 2007, Commissioner Chilton has been a tireless advocate for strong, stable and transparent commodities markets," the group said in its letter to President Obama. "Such markets are essential for determine a fair price for energy, food and other essential commodities that reflect tangible economic fundamentals rather than pure speculation."
The groups also announced support for a list of reforms called for by Chilton in a statement this week, including transparency and oversight of over-the-counter (off-exchange) trading, strong new measures to prevent excessive speculation and additional funding and staff for the CFTC. Bart Chilton is one of four Commissioners that are split evenly between parties (Chilton is a Democrat) and a Chairman that must of the party of the sitting President. Currently, Commissioner Dunn (Dem.) is serving as Acting Chair until a new Chairman is confirmed. Former Goldman Sachs partner Gary Gensler has been nominated for the spot, but has not yet had a Senate hearing. He has also received some skepticism by reform-minded members of the U.S. Senate, including Agriculture Committee Chairman Tom Harkin (D-IA) who will oversee his confirmation hearing.
NEFI and PMAA founded the coalition over a year ago to provide a strong, united front in calling for futures market reform and to combat excessive speculation. Jim Collura, NEFI VP for Government Affairs, is coordinator for the coalition and its activities.

HOUSE AND SENATE LEADERS DRAFT NEW FUTURES MARKET REFORM LEGISLATION
House Agriculture Committee Chairman Colin Peterson (D-MN) and Senate Agriculture Committee Chairman Tom Harking (D-IA) have drafted new futures market reform legislation for consideration in the new Congress. Both pieces of legislation seek to bring new transparency and oversight to unregulated markets and trades, including over-the-counter derivatives and other off-market trades. They also seek to strengthen position limits and other anti-speculation measures. NEFI and PMAA are currently reviewing the legislation. House Ag Committee Chairman Peterson has also announced his intention to hold hearings on his draft legislation next week, and NEFI has confirmed that its immediate past Chairman of the Board and PMAA Treasurer Sean Cota (Cota & Cota, Bellows Falls, VT) will testify on behalf of the industry. Cota is recognizable as a lead industry voice after appearing in a special "60 Minutes" investigative piece two weeks ago. Cota has represented NEFI before U.S. House and Senate committees several times in recent years to testify on this issue. We will update members as things move forward.

ECONOMIC STIMULUS BILL CLEARS HOUSE; HEADS FOR SENATE
In recent issues of this newsletter, we have been reporting to members on attempts by the federal government to stimulate the economy through new legislation. The $219 billion House-passed economic stimulus package, having cleared that chamber by a vote of 244-188 on Wednesday, now heads to the Senate for consideration.
In previous issues, we outlined the provisions of this bill that were of interest to members. Here are the highlights:
Spending measures:
- An additional $1 billion for LIHEAP (for FY2010, available on October 1, 2009)
- $6.2 billion boost to the federal Weatherization Assistance Program (WAP)
- Raises eligibility for the WAP to 200 percent of the federal poverty level and doubles the assistance level from $2,500 per household to $5,000
- $3.5 billion in Energy Efficiency and Conservation Block Grant Funding
- $16 billion to repair public housing and make energy efficiency retrofits
- $6 billion for increasing energy efficiency and conservation at federal buildings
- $600 million for federal fleets to purchase plug-in and alternative fuel vehicles
- $200 million for cleanups under the Leaking Underground Storage Tank (LUST) Fund
Small business loans:
- $426 million for Small Business Administration (SBA) loan guarantee programs
- Allows SBA to temporarily guarantee up to 95 percent of certain qualifying 7(a) small business loans at an exceptionally low rate
- Allows small business to apply directly to the SBA for loans
- Allows businesses to pursue SBA refinancing of existing qualified loans of up to $10 million
- Seeks to break up the “freeze” in the secondary loan market, which has been discouraging some lenders from making new SBA loans
General tax measures
- for tax years 2009 and 2010, a refundable tax credit of up to $500 for individuals making less than $75,000 and $1,000 for families making less than $150,000;
- expansions of the earned income tax credit and child tax credit;
- for first time home buyers purchasing between January 1, 2009 and July 1, 2009, eliminates the repayment obligation of the $7,500 tax credit (under certain conditions);
- an extension through 2009 of bonus depreciation, which allows businesses to immediately write off fifty-percent of their depreciable property purchased in the coming tax year;
- an extension of the current two-year carryback of net operating loses for businesses to a five-year term (denies benefit to bailout recipients);
- an extension of the $250,000 increase for small business expensing while increasing the phase-out to $800,000 for 2008; and
- an employer tax credit equal to 40 percent of the first $6,000 of wages for hiring a veteran or disconnected youth.
Energy tax measures:
- a long-term extension of the renewable energy (wind, solar, geothermal, etc.) production tax credit (a previous energy bill attached to last year’s Wall Street bailout bill had only extended it for one year);
- removes monetary caps for certain wind and solar tax credits;
- extends home energy efficiency tax credits through 2010, increases for 2009 and 2010 the eligible percentage of the amount paid or incurred by the taxpayer from 10 to 30 percent, and eliminates the property-by-property monetary cap and replaces it with a $1,500 aggregate cap;
- for 2009 and 2010, increases the tax credit to fuel station owners who dispense alternative fuels (i.e., E85, biodiesel and natural gas) from 30 percent (cap $30,000) to 50 percent (cap $50,000) and while leaving hydrogen at 30 percent, increases the cap to $500,000;
- for 2009 and 2010, provides an enhanced 20 percent R&D tax credit for the fields of fuel cells, battery technology, renewable energy, energy conservation technology, efficient transmission and distribution of electricity, and carbon capture and sequestration.
The $888 billion Senate stimulus bill was introduced earlier this week. It differs somewhat from the House bill. Summary of the spending portion of the Senate bill. Summary of the tax portion of the Senate bill. The bill is expected to pass the Senate and move onto a House-Senate conference committee, which will work out the differences and send a final bill to both floors for consideration sometime next month. The most likely places for tweaks to the bill, including increases to tax breaks and other measures being called for by Republicans, are by amendment on the Senate floor this week or during the conference committee process, assuming the bill passes the Senate. UL TECHNICAL REVIEW OPENS DOORS FOR SUCCESSFUL MARKET ENTRY OF BIOHEAT®

Recently, Underwriters Laboratory (UL) declared that biodiesel blends up to B5 used in equipment designed to operate on diesel fuel and heating oil posed no adverse safety issues. This announcement is a milestone for an industry that hasn’t had much advancement in the heating oil fuel supply for decades. Bioheat® can begin now to make inroads into the heating oil supply and OEM’s, fuel suppliers and homeowners can be comfortable that they are recipients of a high quality fuel.
Much has been stated about biodiesel’s possible contribution to additional fuel quality challenges such as fuel instability, premature tank cleaning and microbial contamination. Clearly these types of operational challenges are those that the industry is now familiar with and will continue to work through, before during and after Bioheat’s wide spread commercialization. The net result of this new fuel combined with proactive fuel management practices, ensures a positive user experience.
Complementing this exciting news from UL is that biodiesel boasts a positive energy balance delivering 3.5 units of energy for every 1 unit of energy of input, while other fuels and generic petroleum fall shy by comparison. U.S. biodiesel manufacturers are now producing a sustainable fuel that is good for the environment and there is significant, credible research bearing this out, see (www.biodieselsustainability.com). If the UL approval, biodiesel’s positive energy balance and sustainability affirmation are not enough, consider the positive results declared in a report generated by ICF International, titled “Resource Analysis of Energy Use and GHG Emissions from Residential Boilers for Space Heating and Hot Water. As you will see the difference between heating oil and natural gas for greenhouse gases is not substantial and that the modest advantage gas has can be overcome with a percentage of biofuels.

FEDERAL LOAN GUARANTEES FOR ENERGY PROJECTS AVAILABLE
NEFI Policy Advisor, Elizabeth McCarthy attended a webinar on January 29th hosted by, amongst others, the U.S. Department of Energy’s (DOE) department of the Loan Guarantee Program (www.lgprogram.energy.gov). The “Federal Loan Guarantee for Energy Projects” is a pilot program instituted by the DOE to award $10 billion in federal loan guarantees in 2009 to support the development of new technologies that promote energy efficiency, renewable energy and advanced forms of transmission and distribution of electricity. The deadline to apply in the second round of the loan program is February 26, 2009. The application requires the following stipulations: a credit rating by an outside agency (such as Moody’s), an application fee of $800,000 dollars, a debt to equity ratio not greater than 80% to 20%, and a base enterprise value greater than or equal to $25 million dollars. NEFI was contacted by Bob Garside of the Oil Heat Council of New Hampshire with regard to low-income families with sick children. There are about a dozen families in the Granite State that have children on a variety of life-supporting systems that do not have electric generators. Needless to say, when power is lost (as it was recently) this poses a life-threatening crisis for these New Hampshire families. - INDUSTRY TO ADVOCATE FOR LIHEAP IN "MARCH ON WASHINGTON": NEFI will join PMAA, the Massachusetts Oilheat Council, the Oilheat Council of New Hampshire, Oilheat Institute of Rhode Island and the New Jersey Fuel Merchants Association, as well as volunteer fuel dealers from those states, in the annual National Fuel Fund Network “LIHEAP Advocacy Day” on February 11th. The event joins government fuel assistance providers, low income advocates and home energy companies in a "march" on Capitol Hill in support of LIHEAP, weatherization and efficiency programs for low-income consumers. - FOLLOW-UP REGIONAL MEETING ON LOW SULFUR HEATING OIL has been planned for Thursday, February 19th at a to-be announced location near BWI airport in Baltimore, MD. Meeting is a follow up to a meeting earlier this winter by regional air quality officials (NESCUAM and MANE-VU) that was attended by several industry groups and marketers, including PMAA, NEFI, MOC, NORA and others. This course entails both classroom and hands-on heating instruction using live heating equipment and follows an industry-standard curriculum. NEFI is looking to fill a year round position teaching adult students from around the region. Full time and part time candidates are urged to apply. All classes are taught in both the classroom and in NEFI's state-of-the-art lab in Watertown, Massachusetts. Candidates must have a valid Massachusetts oil burner license.

DRUG/ALCOHOL TESTING & EMPLOYEE ASSISTANCE PROGRAM OFFER

In addition to the Drug/Alcohol Testing Program offered there is an optional Employee Assistance Program (EAP) to provide your staff with a 24-hour, 7 days a week counseling and referral service to help employees deal with personal issues before they become work performance issues. Counselors are available to deal with substance abuse, marital and family issues, personal crises, etc. The Substance Abuse Professional (SAP) is REQUIRED when any employee tests positive for drugs and/or alcohol. A SAP is a licensed physician or a licensed/certified psychologist, social worker, employee assistance professional, or addiction counselor with knowledge of and clinical experience in the diagnosis and treatment of alcohol and controlled substance related disorders. An evaluation by a SAP is included with the Employee Assistance Program. If chosen as an option, the EAP will be available to your employees, their dependents, and to your management and supervisory staff to assist in job performance concerns.
The NEFI-Newport Alliance Consortium is the only NEFI-endorsed Drug /Alcohol Testing and Employee Assistance Program. SAFETY VESTS NOW AVAILABLE:
The Federal Highway Administration has required workers within the right of way of any federal aid highway to wear high visibility safety vests since November 24, 2008. The NEFI Action Center has a bulletin available on this at www.nefiactioncenter.com. It is available in the Federal Regulations section (MEMBERS ONLY).
