Stop Excessive Speculation Act: S. 3268
On Wednesday July 16, 2008 another bill directed at reducing excessive speculation was introduced. This new proposal is the product of collaboration between Democratic Senators Harry Reid of Nevada, Charles Schumer of New York, Byron Dorgan of North Dakota and Patty Murray of Washington State. The Stop Excessive Energy Speculation Act of 2008 (S. 3268) would, as proposed, address issues that many consider necessary to combat speculation. It would require the CFTC to categorize only those investors who buy or produce petroleum to be considered legitimate hedgers (in contrast with those seeking only financial gain) and would require the CFTC to enforce position limits. A key objective within this legislation is to help the CFTC obtain information on trades, as much of the problem with policing markets is a lack of 'transparency.' Ideally, market regulators will be able to better run the market place by having timely, accurate data. To this end, S. 3268 will close the 'London Loophole,' a technicality which has allowed traders to conduct business outside the reach of the CFTC (MarketWatch, Laura Mandaro). Debates are expected to begin the week of the 21st. NEFI members should expect to hear more about this as developments occur.

NEFI Joins Coalition Effort to Double Funding For LIHEAP Before Fall
Considering the market situation for heating fuels, especially heating oil (up 55 percent since January) and Natural Gas (up over 80 percent since January), funding for the federal Low Income Home Energy Assistance Program (LIHEAP) is more important than ever. NEFI has joined an array of industry and low income advocacy groups in the national LIHEAP coalition in support of S.3186/H.R.6427, the "Keep Warm in Winter, Cool in Summer Act." The bill would provide an additional $2.53 billion for LIHEAP in the current fiscal year, adding to the $1.98 billion already appropriated to states by Congress and $516.7 million in emergency funding released to states by the President. SPCC: 347,5,53: NEFI Offers Vital Compliance Seminar on SPCC Rule (Deadline July 1st 2009)
As we went to press, there were 347 days, 5 hours and 53 minutes remaining until the SPCC compliance deadline. See the countdown clock at www.nefiactioncenter.com. The NEFI Legislative & Regulatory Action Center is offering an online webinar on compliance with the EPA Spill Prevention, Control and Countermeasure (SPCC) regulations. The FINAL deadline for conforming to the new amendments to the rule and completing the SPCC plan revision and implementation is July 1st, 2009. This rule applies to all owners and operators of petroleum bulk plants that store 1,320 gallons or more in above ground storage. The webinar will feature NEFI Regulatory Council Mark S. Morgan, Esq. (NEFI's compliance attorney) and Tim Laughlin, of the North Carolina Petroleum Marketers & Convenience Store Association, an SPCC expert and engineer in NC and VA. Attending the Webinar is simple: Anyone with internet access can participate. All that is required is a password and a telephone number to dial in (obtained from NEFI after registering).
PLEASE REGISTER ASAP!!! The Webinar will be held on JULY 24, 2008 AT 10:00AM and will take an hour to two hours to complete. The cost for NEFI members is $30 and for non-members is $350.
Members of National Oilheat Research Alliance (nora-oilheat.org) associations and PMAA associations are welcome to take the $30 per person "member rate," according to NEFI CEO Shane Sweet. At press time, 75 individuals, from as far away as Oregon, are registered for the offering.

Biodiesel Pump Labels Now Available!!!
At long last, the biodiesel pump labels are now available for ordering online at www.biodieselpumplabels.com. The majority of the labels shown on the site are being required by the Federal Trade Commission, but NEFI is offering six different versions of the labels for those marketers wanting to clearly mark their dispensers. There are a variety of labels to choose from to accommodate the different levels of biodiesel, and they are similar to the octane labels seen at gasoline stations. This new architecture will provide NEFI with state-of-the-art networking, document storage and backup, redundant server drives and protected power supply, in-house listservs, a collaborative document development platform, improved remote network access for our more mobile personnel, improved wireless email synchronization, a BarracudaTM firewall, internal company web site, global (shared) calendars and contact database, the ability to publish calendars directly to the web, and the flexibility to run both Windows and Linux (Open Source) applications. During the process, our email was down intermittently, so we apologize for any inconvenience this may have caused.
