Compliance date for the original training was October 1, 1993. Retraining for the same information was to be done every two years. Subsequently the recurring training is now every three years. If the original training and/or recurring training have not been done, now is the time to meet your obligation to be in compliance with the current regulations. THIS IS A DOT REQUIREMENT, IT IS NOT SATISFIED BY A HAZMAT ENDORSEMENT ON A CDL. Get the information necessary to ensure your company is in compliance.

To ensure testing and training certification on day of attendance, pre-registration 48 hours before presentation is required.

DOT Hazardous Materials Regulations, 49 CFR Parts 171-177, require that hazmat employees be trained in accordance with these regulations to the extent appropriate with their job responsibilities.

Pursuant to 49 CFR Part 172 Hazardous Materials; Security Requirement (Security Plan) for Offerors and Transporters of Hazardous Materials is now a required part of Hazmat Training for drivers.

Who Must Be Trained?
The Term “Hazmat Employee” is defined as a person who is employed by a hazmat employer and who, in the course of employment, directly affects hazardous materials transportation safety and includes someone who:

  • Loads, unloads, or handles hazardous materials;
  • Tests, reconditions, repairs, modifies, marks, or otherwise represents containers, drums or packaging as qualified for use in the transportation of hazardous materials;
  • Prepares hazardous materials for transportation;
  • Is responsible for safety of transporting hazardous materials; or
  • Operates a vehicle used to transport hazardous materials.

A “Hazmat Employer” is defined as a person who uses one or more employees in connection with:

  • Transporting hazardous materials in commerce;
  • Causing hazardous materials to be transported or shipped in commerce; or representing, marking, certifying, selling, offering, reconditioning, testing, repairing or modifying containers, drums, or packaging as qualified for use in the transportation of hazardous materials.

The regulations require this training be provided to existing employees, as well as to new hires. Training must be completed within 90 days.

There are 4 categories of training within designated HM-126F requirements.

General Awareness/Familiarization Training.
Each hazmat employee must receive general awareness/familiarization training designed to provide familiarity with the requirements of subchapter 49 of the Code of Federal Regulations (CFR). This training will enable the employee to recognize and identify hazardous materials consistent with hazardous communications standards.

Function-Specific Training.
Each hazmat employee must receive function-specific training concerning requirements that are specifically applicable to the functions performed by the employee.

Safety Training.
Each hazmat employee must receive safety training concerning:

  • Emergency response information;
  • Measures to protect the employee from the dangers associated with hazardous materials, including steps that the employer has implemented to safeguard his or her employees from the exposure; and
  • Methods and procedures for avoiding accidents, such as the proper procedures for handling product.

Driver Training.
It may be possible in some circumstances, to rely upon an employee’s CDL to satisfy this training requirement. For employers of hazmat and tank vehicle drivers who have received an FHWA hazardous materials endorsement to their CDLs, individual determinations may be made as to whether the endorsement satisfies the final rule.
